Biopiracy is a practice characterized by access to biodiversity (genetic heritage) and associated traditional knowledge without the prior consent of states or countries that provide these heritage, as well as the fair and equitable distribution of benefits derived from its use, to integrate the formulation of various types of products that have commercial value, such as pharmaceuticals. Biopiracy can be carried out internally - when products and knowledge are used improperly between states of the federation -, as it can be practiced violating the sovereignty of the countries providers. The state of Amapá is inserted in the Amazon region and has rich biodiversity and culture, this comes from knowledge of traditional and indigenous communities. In addition, the state is located in the international border region with Suriname and French Guiana, with the Franco-Brazilian Amazon border being the largest extension with the Amapá. The city of Oiapoque, in turn, is the city that presents on this border a very dynamic relationship with French Guiana, which is why it was chosen as a study site. Qualitative and exploratory, the research aims to analyze the occurrence of biopiracy on the Franco-Brazilian Amazon border in the city of Oiapoque. To this end, it undertakes a literature review on important concepts for the development of work, such as biopiracy, French-Brazilian Amazon border, traditional communities and mechanisms of prevention against biopiracy, as well asthe conduct of unstructured interviews, of the focused type, with public agents of bodies responsible for the supervision and preservation of biodiversity and residents of the city of Oiapoque.
